Purpose of Urbexplorer<\/h2>\r\n\r\n<p>\r\nUrbexplorer is a platform for documenting, discovering, discussing and sharing information about abandoned,\r\ndisused, historical or otherwise interesting locations (\u201cPlaces\u201d or \u201cLost Places\u201d).\r\n<\/p>\r\n\r\n<p>\r\nThe Services are provided for <strong>informational, documentary and community purposes only<\/strong>.\r\n<\/p>\r\n\r\n<p>A Place being listed on Urbexplorer does <strong>nicht<\/strong> mean that:<\/p>\r\n\r\n<ul>\r\n    <li>the Place is legally accessible;<\/li>\r\n    <li>entry is permitted by the owner, occupier or authorities;<\/li>\r\n    <li>the Place is abandoned or unowned;<\/li>\r\n    <li>the Place is safe to enter or visit;<\/li>\r\n    <li>the information, coordinates, photographs or descriptions are complete or current; or<\/li>\r\n    <li>Urbexplorer recommends or encourages visiting or entering the Place.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nUrbexplorer does not grant permission to enter any property. Users are responsible for determining whether\r\nthey may lawfully and safely access any location.\r\n<\/p>\r\n\r\n<h2>2. Eligibility<\/h2>\r\n\r\n<p>\r\nThe Services are intended for persons who are <strong>18 years of age or older<\/strong>.\r\n<\/p>\r\n\r\n<p>\r\nBy creating an account or using account-based features, you confirm that you are at least 18 years old and\r\nlegally capable of entering into these Terms.\r\n<\/p>\r\n\r\n<p>\r\nWe may restrict or terminate access where we reasonably believe that eligibility requirements are not met.\r\n<\/p>\r\n\r\n<h2>3. Accounts and Account Security<\/h2>\r\n\r\n<p>Certain features require an Urbexplorer account.<\/p>\r\n\r\n<p>You are responsible for:<\/p>\r\n\r\n<ul>\r\n    <li>providing reasonably accurate registration information;<\/li>\r\n    <li>keeping your login credentials secure;<\/li>\r\n    <li>activity carried out through your account; and<\/li>\r\n    <li>notifying us if you become aware of unauthorized access to your account.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nYou must not impersonate another person, create accounts for abusive or fraudulent purposes, or attempt to\r\nbypass restrictions placed on an account.\r\n<\/p>\r\n\r\n<p>\r\nAccounts may not be sold, transferred or commercially traded without our permission.\r\n<\/p>\r\n\r\n<h2>4. Member Access and Place Submissions<\/h2>\r\n\r\n<p>\r\nSome parts of Urbexplorer, including certain map or location information, may require\r\n<strong>Member Access<\/strong>.\r\n<\/p>\r\n\r\n<p>Member Access may be obtained through methods offered by Urbexplorer from time to time, including:<\/p>\r\n\r\n<ul>\r\n    <li>submitting a Place that we review and accept; or<\/li>\r\n    <li>purchasing permanent Member Access where such an option is offered.<\/li>\r\n<\/ul>\r\n\r\n<h3>4.1 Access through a Place submission<\/h3>\r\n\r\n<p>\r\nSubmitting a Place does <strong>not automatically entitle you to Member Access<\/strong>.\r\n<\/p>\r\n\r\n<p>\r\nSubmissions are reviewed by us and may be accepted, rejected, merged with an existing Place, or require\r\nadditional information.\r\n<\/p>\r\n\r\n<p>Reasons why a submission may not result in Member Access include, for example:<\/p>\r\n\r\n<ul>\r\n    <li>the Place already exists on Urbexplorer;<\/li>\r\n    <li>the submission cannot reasonably be verified;<\/li>\r\n    <li>insufficient or inaccurate information was provided;<\/li>\r\n    <li>submitted material does not meet our quality or moderation requirements; or<\/li>\r\n    <li>the submission violates these Terms.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nWe may use suitable information, descriptions, photographs or other media from a submission to improve or\r\nsupplement an existing Place even where the submission itself does not result in a new Place or Member Access,\r\nprovided that the relevant content may lawfully be used under the license granted in these Terms.\r\n<\/p>\r\n\r\n<p>\r\nWe may grant Member Access in individual cases at our discretion, including where a submission has been\r\nmerged with an existing Place.\r\n<\/p>\r\n\r\n<p>\r\nMember Access is granted only when Urbexplorer expressly confirms that access has been awarded.\r\n<\/p>\r\n\r\n<h3>4.2 Purchased Member Access<\/h3>\r\n\r\n<p>\r\nWhere permanent Member Access is offered for purchase, payment grants Member Access to the associated\r\nUrbexplorer account without a recurring membership fee.\r\n<\/p>\r\n\r\n<p>\r\n\u201cPermanent\u201d means that the access does not expire merely because time passes. It does not mean that\r\nUrbexplorer guarantees that the Services will operate forever or that an account can never be restricted,\r\nsuspended or terminated under these Terms.\r\n<\/p>\r\n\r\n<p>Purchased Member Access may be revoked where:<\/p>\r\n\r\n<ul>\r\n    <li>the relevant payment is refunded, reversed or charged back;<\/li>\r\n    <li>the purchase was fraudulent or unauthorized; or<\/li>\r\n    <li>the account is suspended or terminated in accordance with these Terms.<\/li>\r\n<\/ul>\r\n\r\n<p>Mandatory statutory rights remain unaffected.<\/p>\r\n\r\n<h2>5. Pro Subscriptions<\/h2>\r\n\r\n<p>\r\nUrbexplorer may offer optional recurring subscriptions under names such as <strong>Urbexplorer Pro<\/strong>.\r\n<\/p>\r\n\r\n<p>\r\nThe current subscription price, billing interval and included benefits are displayed before purchase.\r\n<\/p>\r\n\r\n<p>\r\nSubscriptions may provide additional or enhanced features. The specific benefits may evolve as Urbexplorer\r\ndevelops.\r\n<\/p>\r\n\r\n<p>\r\nWe may add, modify or replace subscription features where reasonably necessary to develop or operate the\r\nServices. Material changes that substantially affect an existing paid subscription will be handled in\r\naccordance with applicable law and, where required, communicated to affected users.\r\n<\/p>\r\n\r\n<p>\r\nSubscriptions automatically renew where indicated during purchase until cancelled.\r\n<\/p>\r\n\r\n<p>\r\nUnless otherwise required by applicable law or the relevant payment platform, cancellation stops future\r\nrenewals and access to subscription benefits remains available until the end of the already-paid billing period.\r\n<\/p>\r\n\r\n<p>\r\nInstructions for managing or cancelling a subscription are provided through the relevant purchase platform\r\nor within the Services where applicable.\r\n<\/p>\r\n\r\n<h2>6. Payments, App Stores and Refunds<\/h2>\r\n\r\n<p>\r\nPayments may be processed by third-party payment platforms, app stores or payment providers.\r\n<\/p>\r\n\r\n<p>\r\nDepending on where a purchase is made, additional payment terms of the relevant provider may apply.\r\n<\/p>\r\n\r\n<p>\r\nPurchases made through the Apple App Store or Google Play are also subject to the applicable store's payment,\r\ncancellation and refund rules.\r\n<\/p>\r\n\r\n<p>\r\nWhere a purchase is made directly through Urbexplorer or its website, applicable statutory consumer rights,\r\nincluding any applicable withdrawal rights, remain unaffected.\r\n<\/p>\r\n\r\n<p>\r\nUnless expressly stated otherwise, we do not provide additional voluntary refund or withdrawal rights beyond\r\nthose required by applicable law or the applicable payment platform.\r\n<\/p>\r\n\r\n<h2>7. User Contributions<\/h2>\r\n\r\n<p>Users may submit or publish content through the Services, including:<\/p>\r\n\r\n<ul>\r\n    <li>Places and location information;<\/li>\r\n    <li>descriptions and other text;<\/li>\r\n    <li>photographs and other media;<\/li>\r\n    <li>comments;<\/li>\r\n    <li>Beitr\u00e4ge aus der Community;<\/li>\r\n    <li>profile information; and<\/li>\r\n    <li>other user-generated content.<\/li>\r\n<\/ul>\r\n\r\n<p>Together, these are referred to as \u201cContributions\u201d.<\/p>\r\n\r\n<p>You remain responsible for your Contributions.<\/p>\r\n\r\n<p>By submitting a Contribution, you confirm that:<\/p>\r\n\r\n<ul>\r\n    <li>you have the necessary rights to submit and share it;<\/li>\r\n    <li>it does not unlawfully infringe copyright, privacy, personality, property or other rights;<\/li>\r\n    <li>it does not contain unlawfully obtained personal information;<\/li>\r\n    <li>it is not deliberately false or misleading; and<\/li>\r\n    <li>it does not violate these Terms or applicable law.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nYou must not submit content merely because it is publicly accessible elsewhere if you do not have the right\r\nto reproduce or distribute it.\r\n<\/p>\r\n\r\n<h2>8. License for User Contributions<\/h2>\r\n\r\n<p>You retain ownership of your Contributions.<\/p>\r\n\r\n<p>\r\nBy submitting Contributions to Urbexplorer, you grant us a\r\n<strong>non-exclusive, worldwide, royalty-free license<\/strong>\r\nto host, store, reproduce, display, publish, format, resize, crop, adapt and distribute\r\nthe Contributions as reasonably necessary to operate, maintain, improve and present\r\nthe Services.\r\n<\/p>\r\n\r\n<p>This includes, where appropriate:<\/p>\r\n\r\n<ul>\r\n    <li>displaying submitted photographs on Place pages;<\/li>\r\n    <li>incorporating information from a submission into an existing Place;<\/li>\r\n    <li>correcting formatting, spelling or presentation;<\/li>\r\n    <li>selecting or reordering submitted media;<\/li>\r\n    <li>creating thumbnails or technically optimized versions; and<\/li>\r\n    <li>displaying Contributions through the website and mobile applications.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nThis license does not transfer ownership of your Contributions to Urbexplorer.\r\n<\/p>\r\n\r\n<p>\r\nIf your account is deleted, Contributions that must be deleted under applicable law\r\nor platform requirements will be removed or anonymized as appropriate.\r\n<\/p>\r\n\r\n<p>\r\nWhere purely factual Place information can lawfully remain without identifying you,\r\nsuch information may continue to form part of the Urbexplorer database in anonymized\r\nform.\r\n<\/p>\r\n\r\n<p>\r\nAny license granted under this section continues only to the extent reasonably\r\nnecessary for content that is lawfully retained after account deletion.\r\n<\/p>\r\n\r\n\r\n<h2>9. Account Deletion and Contributions<\/h2>\r\n\r\n<p>\r\nDu kannst die L\u00f6schung deines Urbexplorer-Kontos wie folgt beantragen:\r\n<\/p>\r\n\r\n<ul>\r\n    <li>\r\n        the account deletion option provided within the Urbexplorer mobile application; or\r\n    <\/li>\r\n    <li>\r\n        unsere Seite zum L\u00f6schen \u00f6ffentlicher Konten unter\r\n        <a href=\"https:\/\/urbexplorer.net\/de\/delete-account\/\">https:\/\/urbexplorer.net\/delete-account\/<\/a>.\r\n    <\/li>\r\n<\/ul>\r\n\r\n<p>\r\nWe may request reasonable verification before processing a deletion request in order\r\nto prevent unauthorized or fraudulent deletion of an account.\r\n<\/p>\r\n\r\n<p>\r\nWhen your account is deleted, personal account information associated with the account\r\nwill be deleted or anonymized where required by applicable law.\r\n<\/p>\r\n\r\n<p>\r\nUser-generated content that is directly associated with you, such as profile content,\r\ncommunity posts, comments, uploaded photographs and other personal Contributions,\r\nwill be deleted or anonymized as appropriate.\r\n<\/p>\r\n\r\n<p>\r\nPrivate messages, private group content and similar account-related data will also be\r\nhandled in accordance with applicable privacy and platform requirements.\r\n<\/p>\r\n\r\n<p>\r\nPurely factual Place information may remain in the Urbexplorer database where it can\r\nbe retained without identifying you and where continued retention is legally permitted.\r\nFor example, factual descriptions, coordinates or non-personal Place information may\r\nbe retained in anonymized form in order to preserve the integrity of the location\r\ndatabase.\r\n<\/p>\r\n\r\n<p>\r\nDeletion of an account does not necessarily require deletion of factual information\r\nabout a Place solely because that information was originally submitted through the\r\ndeleted account.\r\n<\/p>\r\n\r\n<p>\r\nCertain information may continue to be retained where reasonably necessary to comply\r\nwith legal obligations, accounting requirements, fraud prevention, security,\r\ndispute resolution or the establishment, exercise or defence of legal claims.\r\n<\/p>\r\n\r\n<p>\r\nDeleted information may remain temporarily in technical backups until those backups\r\nare routinely overwritten or expire.\r\n<\/p>\r\n\r\n<h2>10. Location Information, Maps and Safety<\/h2>\r\n\r\n<p>\r\nLocation information provided through Urbexplorer may include coordinates, map markers, descriptions,\r\nphotographs and information supplied by users or other sources.\r\n<\/p>\r\n\r\n<p>\r\nSuch information may be inaccurate, incomplete, outdated or affected by changes at the location.\r\n<\/p>\r\n\r\n<p>\r\nYou must <strong>not rely on Urbexplorer as confirmation that a location is lawful, accessible or safe to\r\nvisit<\/strong>.\r\n<\/p>\r\n\r\n<p>Users must respect:<\/p>\r\n\r\n<ul>\r\n    <li>property rights;<\/li>\r\n    <li>access restrictions;<\/li>\r\n    <li>signs and barriers;<\/li>\r\n    <li>applicable laws and regulations;<\/li>\r\n    <li>instructions from property owners or authorities; and<\/li>\r\n    <li>their own safety and the safety of others.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nThe availability of coordinates, map markers, directions, photographs, descriptions or offline location\r\ninformation is not an invitation, instruction or authorization to enter a Place.\r\n<\/p>\r\n\r\n<p>\r\nYou must not use Urbexplorer to facilitate trespassing, unlawful entry, vandalism, theft, damage to property\r\nor other unlawful or dangerous conduct.\r\n<\/p>\r\n\r\n<p>\r\nNever rely on Urbexplorer as an emergency, navigation or safety service.\r\n<\/p>\r\n\r\n<h2>11. Offline and Saved Content<\/h2>\r\n\r\n<p>\r\nCertain versions of the Services may allow Places or other information to be saved or made available offline.\r\n<\/p>\r\n\r\n<p>\r\nOffline or cached information may become outdated and may differ from the current information available\r\nthrough the Services.\r\n<\/p>\r\n\r\n<p>\r\nWe do not guarantee that offline information will remain available indefinitely, remain synchronized or\r\nreflect changes to a Place.\r\n<\/p>\r\n\r\n<p>\r\nThe same legal and safety restrictions that apply to online location information also apply to saved or\r\noffline information.\r\n<\/p>\r\n\r\n<h2>12. Community Rules and Prohibited Conduct<\/h2>\r\n\r\n<p>You must not use the Services to:<\/p>\r\n\r\n<ul>\r\n    <li>encourage, organize or promote unlawful activity;<\/li>\r\n    <li>encourage unlawful entry onto private or restricted property;<\/li>\r\n    <li>publish content that unlawfully threatens, harasses or targets another person;<\/li>\r\n    <li>publish illegal, fraudulent or intentionally misleading content;<\/li>\r\n    <li>infringe intellectual-property or privacy rights;<\/li>\r\n    <li>publish personal or sensitive information without a lawful basis;<\/li>\r\n    <li>distribute malware or interfere with the security or operation of the Services;<\/li>\r\n    <li>abuse reporting, moderation or community systems;<\/li>\r\n    <li>manipulate ratings, engagement or other platform features;<\/li>\r\n    <li>scrape, systematically extract or harvest non-public data without permission;<\/li>\r\n    <li>use bots or automated systems in a manner that disrupts the Services;<\/li>\r\n    <li>circumvent access controls or technical restrictions; or<\/li>\r\n    <li>use information from Urbexplorer for unlawful or harmful purposes.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nWe may adopt additional community or submission guidelines from time to time. Where such guidelines impose\r\nrestrictions on Contributions, they form part of the rules governing use of the relevant feature.\r\n<\/p>\r\n\r\n<h2>13. Content Moderation<\/h2>\r\n\r\n<p>\r\nUrbexplorer moderates user-generated content in order to maintain the quality, safety and legality of the\r\nServices.\r\n<\/p>\r\n\r\n<p>Moderation may include:<\/p>\r\n\r\n<ul>\r\n    <li>human review of submitted Places and reports;<\/li>\r\n    <li>editing or formatting Contributions;<\/li>\r\n    <li>rejecting or removing Contributions;<\/li>\r\n    <li>merging duplicate Places or information;<\/li>\r\n    <li>limiting visibility of content;<\/li>\r\n    <li>restricting posting or account functionality;<\/li>\r\n    <li>suspending or terminating accounts; and<\/li>\r\n    <li>technical or automated measures used for spam prevention, security, duplicate detection or similar operational purposes.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nModeration does not mean that we verify or endorse every Contribution.\r\n<\/p>\r\n\r\n<p>\r\nThe presence of content on Urbexplorer does not constitute confirmation that the content is accurate,\r\nlawful or safe.\r\n<\/p>\r\n\r\n<p>\r\nWe may take action against content that violates these Terms even where the content is not necessarily\r\nunlawful.\r\n<\/p>\r\n\r\n<p>\r\nWhere required by applicable law, we will provide information about relevant moderation decisions and\r\navailable means of redress.\r\n<\/p>\r\n\r\n<h2>14. Reporting Illegal or Infringing Content<\/h2>\r\n\r\n<p>\r\nIf you believe specific content on Urbexplorer is illegal, unlawfully infringes your rights, or should\r\notherwise be reviewed for legal reasons, you may report it through our publicly accessible\r\n<a href=\"https:\/\/urbexplorer.net\/de\/kontakt\/\">Kontaktseite<\/a>.\r\n<\/p>\r\n\r\n<p>\r\nYou do not need to be logged in to submit such a report.\r\n<\/p>\r\n\r\n<p>To help us assess the report, please provide:<\/p>\r\n\r\n<ul>\r\n    <li>the exact URL or other clear identification of the content;<\/li>\r\n    <li>an explanation of why you believe the content is illegal or infringing;<\/li>\r\n    <li>your name and email address where required or reasonably necessary; and<\/li>\r\n    <li>sufficient information or supporting material for us to assess the report.<\/li>\r\n<\/ul>\r\n\r\n<p>\r\nWhere applicable, please confirm that you believe in good faith that the information in your report is\r\naccurate and complete.\r\n<\/p>\r\n\r\n<p>\r\nWe may request additional information where reasonably necessary.\r\n<\/p>\r\n\r\n<p>\r\nReports are assessed on their individual circumstances. Submission of a report does not automatically\r\nguarantee removal.\r\n<\/p>\r\n\r\n<p>\r\nAdditional reporting or removal tools offered on individual Place pages may be provided for convenience\r\nand do not replace the public contact option described above.\r\n<\/p>\r\n\r\n<h2>15. Intellectual Property of Urbexplorer<\/h2>\r\n\r\n<p>\r\nUnless otherwise stated, the design, branding, software, graphics, databases and other original material\r\nforming part of Urbexplorer are owned by or licensed to us.\r\n<\/p>\r\n\r\n<p>You may use the Services only for their intended purpose.<\/p>\r\n\r\n<p>\r\nYou may not reproduce, republish, sell, commercially exploit, systematically extract or create a competing\r\ndatabase from protected Urbexplorer content except where permitted by law or with our permission.\r\n<\/p>\r\n\r\n<p>\r\nThird-party trademarks and content remain the property of their respective owners.\r\n<\/p>\r\n\r\n<h2>17. Third-Party Services<\/h2>\r\n\r\n<p>\r\nThe Services may integrate or link to third-party services, including mapping providers, payment providers,\r\napp stores, advertising providers or external websites.\r\n<\/p>\r\n\r\n<p>\r\nThird-party services are governed by their own terms and privacy practices.\r\n<\/p>\r\n\r\n<p>\r\nWe are not responsible for the independent operation, availability or content of third-party services,\r\nexcept where applicable law provides otherwise.\r\n<\/p>\r\n\r\n<h2>18.
