These Terms and Conditions (“Terms”) govern your access to and use of Urbexplorer, including the website urbexplorer.net, the Urbexplorer mobile applications, community features, maps, location information, offline features, and any other related services provided by Urbexplorer (collectively, the “Services”).

Information about the operator of Urbexplorer can be found in our Imprint.

By creating an account or otherwise expressly agreeing to these Terms, you enter into an agreement with us subject to these Terms.

If you do not agree to these Terms, you must not create an account or use parts of the Services that require acceptance of these Terms.

1. Purpose of Urbexplorer

Urbexplorer is a platform for documenting, discovering, discussing and sharing information about abandoned, disused, historical or otherwise interesting locations (“Places” or “Lost Places”).

The Services are provided for informational, documentary and community purposes only.

A Place being listed on Urbexplorer does not mean that:

  • the Place is legally accessible;
  • entry is permitted by the owner, occupier or authorities;
  • the Place is abandoned or unowned;
  • the Place is safe to enter or visit;
  • the information, coordinates, photographs or descriptions are complete or current; or
  • Urbexplorer recommends or encourages visiting or entering the Place.

Urbexplorer does not grant permission to enter any property. Users are responsible for determining whether they may lawfully and safely access any location.

2. Eligibility

The Services are intended for persons who are 18 years of age or older.

By creating an account or using account-based features, you confirm that you are at least 18 years old and legally capable of entering into these Terms.

We may restrict or terminate access where we reasonably believe that eligibility requirements are not met.

3. Accounts and Account Security

Certain features require an Urbexplorer account.

You are responsible for:

  • providing reasonably accurate registration information;
  • keeping your login credentials secure;
  • activity carried out through your account; and
  • notifying us if you become aware of unauthorized access to your account.

You must not impersonate another person, create accounts for abusive or fraudulent purposes, or attempt to bypass restrictions placed on an account.

Accounts may not be sold, transferred or commercially traded without our permission.

4. Member Access and Place Submissions

Some parts of Urbexplorer, including certain map or location information, may require Member Access.

Member Access may be obtained through methods offered by Urbexplorer from time to time, including:

  • submitting a Place that we review and accept; or
  • purchasing permanent Member Access where such an option is offered.

4.1 Access through a Place submission

Submitting a Place does not automatically entitle you to Member Access.

Submissions are reviewed by us and may be accepted, rejected, merged with an existing Place, or require additional information.

Reasons why a submission may not result in Member Access include, for example:

  • the Place already exists on Urbexplorer;
  • the submission cannot reasonably be verified;
  • insufficient or inaccurate information was provided;
  • submitted material does not meet our quality or moderation requirements; or
  • the submission violates these Terms.

We may use suitable information, descriptions, photographs or other media from a submission to improve or supplement an existing Place even where the submission itself does not result in a new Place or Member Access, provided that the relevant content may lawfully be used under the license granted in these Terms.

We may grant Member Access in individual cases at our discretion, including where a submission has been merged with an existing Place.

Member Access is granted only when Urbexplorer expressly confirms that access has been awarded.

4.2 Purchased Member Access

Where permanent Member Access is offered for purchase, payment grants Member Access to the associated Urbexplorer account without a recurring membership fee.

“Permanent” means that the access does not expire merely because time passes. It does not mean that Urbexplorer guarantees that the Services will operate forever or that an account can never be restricted, suspended or terminated under these Terms.

Purchased Member Access may be revoked where:

  • the relevant payment is refunded, reversed or charged back;
  • the purchase was fraudulent or unauthorized; or
  • the account is suspended or terminated in accordance with these Terms.

Mandatory statutory rights remain unaffected.

5. Pro Subscriptions

Urbexplorer may offer optional recurring subscriptions under names such as Urbexplorer Pro.

The current subscription price, billing interval and included benefits are displayed before purchase.

Subscriptions may provide additional or enhanced features. The specific benefits may evolve as Urbexplorer develops.

We may add, modify or replace subscription features where reasonably necessary to develop or operate the Services. Material changes that substantially affect an existing paid subscription will be handled in accordance with applicable law and, where required, communicated to affected users.

Subscriptions automatically renew where indicated during purchase until cancelled.

Unless otherwise required by applicable law or the relevant payment platform, cancellation stops future renewals and access to subscription benefits remains available until the end of the already-paid billing period.

Instructions for managing or cancelling a subscription are provided through the relevant purchase platform or within the Services where applicable.

6. Payments, App Stores and Refunds

Payments may be processed by third-party payment platforms, app stores or payment providers.

Depending on where a purchase is made, additional payment terms of the relevant provider may apply.

Purchases made through the Apple App Store or Google Play are also subject to the applicable store's payment, cancellation and refund rules.

Where a purchase is made directly through Urbexplorer or its website, applicable statutory consumer rights, including any applicable withdrawal rights, remain unaffected.

Unless expressly stated otherwise, we do not provide additional voluntary refund or withdrawal rights beyond those required by applicable law or the applicable payment platform.

7. User Contributions

Users may submit or publish content through the Services, including:

  • Places and location information;
  • descriptions and other text;
  • photographs and other media;
  • comments;
  • community posts;
  • profile information; and
  • other user-generated content.

Together, these are referred to as “Contributions”.

You remain responsible for your Contributions.

By submitting a Contribution, you confirm that:

  • you have the necessary rights to submit and share it;
  • it does not unlawfully infringe copyright, privacy, personality, property or other rights;
  • it does not contain unlawfully obtained personal information;
  • it is not deliberately false or misleading; and
  • it does not violate these Terms or applicable law.

You must not submit content merely because it is publicly accessible elsewhere if you do not have the right to reproduce or distribute it.

8. License for User Contributions

You retain ownership of your Contributions.

By submitting Contributions to Urbexplorer, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, format, resize, crop, adapt and distribute the Contributions as reasonably necessary to operate, maintain, improve and present the Services.

This includes, where appropriate:

  • displaying submitted photographs on Place pages;
  • incorporating information from a submission into an existing Place;
  • correcting formatting, spelling or presentation;
  • selecting or reordering submitted media;
  • creating thumbnails or technically optimized versions; and
  • displaying Contributions through the website and mobile applications.

This license does not transfer ownership of your Contributions to Urbexplorer.

If your account is deleted, Contributions that must be deleted under applicable law or platform requirements will be removed or anonymized as appropriate.

Where purely factual Place information can lawfully remain without identifying you, such information may continue to form part of the Urbexplorer database in anonymized form.

Any license granted under this section continues only to the extent reasonably necessary for content that is lawfully retained after account deletion.

9. Account Deletion and Contributions

You may request deletion of your Urbexplorer account through:

We may request reasonable verification before processing a deletion request in order to prevent unauthorized or fraudulent deletion of an account.

When your account is deleted, personal account information associated with the account will be deleted or anonymized where required by applicable law.

User-generated content that is directly associated with you, such as profile content, community posts, comments, uploaded photographs and other personal Contributions, will be deleted or anonymized as appropriate.

Private messages, private group content and similar account-related data will also be handled in accordance with applicable privacy and platform requirements.

Purely factual Place information may remain in the Urbexplorer database where it can be retained without identifying you and where continued retention is legally permitted. For example, factual descriptions, coordinates or non-personal Place information may be retained in anonymized form in order to preserve the integrity of the location database.

Deletion of an account does not necessarily require deletion of factual information about a Place solely because that information was originally submitted through the deleted account.

Certain information may continue to be retained where reasonably necessary to comply with legal obligations, accounting requirements, fraud prevention, security, dispute resolution or the establishment, exercise or defence of legal claims.

Deleted information may remain temporarily in technical backups until those backups are routinely overwritten or expire.

10. Location Information, Maps and Safety

Location information provided through Urbexplorer may include coordinates, map markers, descriptions, photographs and information supplied by users or other sources.

Such information may be inaccurate, incomplete, outdated or affected by changes at the location.

You must not rely on Urbexplorer as confirmation that a location is lawful, accessible or safe to visit.

Users must respect:

  • property rights;
  • access restrictions;
  • signs and barriers;
  • applicable laws and regulations;
  • instructions from property owners or authorities; and
  • their own safety and the safety of others.

The availability of coordinates, map markers, directions, photographs, descriptions or offline location information is not an invitation, instruction or authorization to enter a Place.

You must not use Urbexplorer to facilitate trespassing, unlawful entry, vandalism, theft, damage to property or other unlawful or dangerous conduct.

Never rely on Urbexplorer as an emergency, navigation or safety service.

11. Offline and Saved Content

Certain versions of the Services may allow Places or other information to be saved or made available offline.

Offline or cached information may become outdated and may differ from the current information available through the Services.

We do not guarantee that offline information will remain available indefinitely, remain synchronized or reflect changes to a Place.

The same legal and safety restrictions that apply to online location information also apply to saved or offline information.

12. Community Rules and Prohibited Conduct

You must not use the Services to:

  • encourage, organize or promote unlawful activity;
  • encourage unlawful entry onto private or restricted property;
  • publish content that unlawfully threatens, harasses or targets another person;
  • publish illegal, fraudulent or intentionally misleading content;
  • infringe intellectual-property or privacy rights;
  • publish personal or sensitive information without a lawful basis;
  • distribute malware or interfere with the security or operation of the Services;
  • abuse reporting, moderation or community systems;
  • manipulate ratings, engagement or other platform features;
  • scrape, systematically extract or harvest non-public data without permission;
  • use bots or automated systems in a manner that disrupts the Services;
  • circumvent access controls or technical restrictions; or
  • use information from Urbexplorer for unlawful or harmful purposes.

We may adopt additional community or submission guidelines from time to time. Where such guidelines impose restrictions on Contributions, they form part of the rules governing use of the relevant feature.

13. Content Moderation

Urbexplorer moderates user-generated content in order to maintain the quality, safety and legality of the Services.

Moderation may include:

  • human review of submitted Places and reports;
  • editing or formatting Contributions;
  • rejecting or removing Contributions;
  • merging duplicate Places or information;
  • limiting visibility of content;
  • restricting posting or account functionality;
  • suspending or terminating accounts; and
  • technical or automated measures used for spam prevention, security, duplicate detection or similar operational purposes.

Moderation does not mean that we verify or endorse every Contribution.

The presence of content on Urbexplorer does not constitute confirmation that the content is accurate, lawful or safe.

We may take action against content that violates these Terms even where the content is not necessarily unlawful.

Where required by applicable law, we will provide information about relevant moderation decisions and available means of redress.

14. Reporting Illegal or Infringing Content

If you believe specific content on Urbexplorer is illegal, unlawfully infringes your rights, or should otherwise be reviewed for legal reasons, you may report it through our publicly accessible contact page.

You do not need to be logged in to submit such a report.

To help us assess the report, please provide:

  • the exact URL or other clear identification of the content;
  • an explanation of why you believe the content is illegal or infringing;
  • your name and email address where required or reasonably necessary; and
  • sufficient information or supporting material for us to assess the report.

Where applicable, please confirm that you believe in good faith that the information in your report is accurate and complete.

We may request additional information where reasonably necessary.

Reports are assessed on their individual circumstances. Submission of a report does not automatically guarantee removal.

Additional reporting or removal tools offered on individual Place pages may be provided for convenience and do not replace the public contact option described above.

15. Property Owners and Removal Requests

If you are the owner, occupier, authorized manager or legal representative of a Place listed on Urbexplorer and wish to request removal or modification of content, please contact us.

We may request reasonable evidence of your connection to the property, such as documentation or other information that allows us to verify the request.

We may also request information necessary to identify the relevant Place.

Each request is assessed individually.

Nothing in this section limits any rights you may have under applicable law.

16. Intellectual Property of Urbexplorer

Unless otherwise stated, the design, branding, software, graphics, databases and other original material forming part of Urbexplorer are owned by or licensed to us.

You may use the Services only for their intended purpose.

You may not reproduce, republish, sell, commercially exploit, systematically extract or create a competing database from protected Urbexplorer content except where permitted by law or with our permission.

Third-party trademarks and content remain the property of their respective owners.

17. Third-Party Services

The Services may integrate or link to third-party services, including mapping providers, payment providers, app stores, advertising providers or external websites.

Third-party services are governed by their own terms and privacy practices.

We are not responsible for the independent operation, availability or content of third-party services, except where applicable law provides otherwise.

18. Availability and Changes to the Services

We aim to keep Urbexplorer available but do not guarantee uninterrupted or error-free operation.

We may:

  • maintain or update the Services;
  • change technical features;
  • modify the presentation or organization of content;
  • introduce or discontinue features; or
  • temporarily restrict access where necessary for security, maintenance or legal reasons.

Where changes materially affect paid services, we will respect mandatory consumer rights and any obligations applicable to the relevant purchase.

19. Suspension and Termination

We may restrict, suspend or terminate an account or specific functionality where reasonably necessary, including where:

  • these Terms are materially or repeatedly violated;
  • the account is used unlawfully;
  • there is fraud, abuse or a security risk;
  • a user attempts to circumvent access restrictions;
  • payment has been reversed or fraudulently obtained; or
  • suspension is required by law or a competent authority.

Where appropriate and legally required, we will inform the affected user of the relevant decision and available options to challenge it.

Serious or urgent violations may result in immediate action.

Termination does not automatically remove Contributions as described in Section 9.

20. Accuracy and Disclaimer

Urbexplorer is based partly on information provided by users and other sources that may change over time.

To the extent permitted by law, we do not guarantee:

  • the accuracy or completeness of Place information;
  • the precise accuracy of coordinates;
  • the current physical condition of a Place;
  • continued access to any Place;
  • that any Place remains abandoned or unused;
  • that a Place is free from hazards; or
  • that information supplied by another user is reliable.

Users should independently assess information relevant to their own lawful activities.

21. Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

In particular, mandatory liability rules concerning intentional misconduct, gross negligence, personal injury and mandatory consumer rights remain unaffected.

Subject to those mandatory rules, we are not responsible for losses caused solely by:

  • inaccurate or outdated user-generated information;
  • unauthorized or unlawful actions taken by users;
  • a user's decision to enter or visit a location;
  • third-party content or third-party services;
  • temporary service interruptions; or
  • use of the Services contrary to these Terms.

Urbexplorer does not assume responsibility for the physical condition, ownership, accessibility or legality of entering any Place merely because information about that Place appears on the Services.

22. Privacy

Our processing of personal data is described separately in our Privacy Policy.

Information about cookies, similar technologies and relevant consent choices is provided separately where applicable.

Acceptance of these Terms does not by itself constitute consent to data processing where separate consent is required by law.

23. Changes to These Terms

We may update these Terms where reasonably necessary, including because of:

  • changes to the Services;
  • new features;
  • legal or regulatory requirements;
  • security requirements; or
  • changes to our business model.

The current version and its effective date will be made available through the Services.

For material changes, we may notify users through the website, application, account interface, email or another appropriate method.

Where a material change requires renewed agreement, continued access to relevant account-based features may require you to review and expressly accept the updated Terms.

Minor changes that do not materially affect users' rights or obligations may take effect without renewed acceptance where permitted by law.

24. Governing Law and Consumer Rights

These Terms are governed by the laws of Austria, without prejudice to mandatory consumer-protection provisions that may apply in the country where a consumer resides.

Any dispute shall be subject to the courts having jurisdiction under applicable law.

Nothing in these Terms deprives consumers of mandatory rights or legal remedies available to them under applicable consumer law.

25. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.

An invalid provision will be interpreted or replaced only to the extent necessary under applicable law.
